Terms of Service: Gagged

1. Acceptance & Scope

By accessing or using the Gagged mobile application (the "Service"), you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and Gagged ("the Company," "we," "us," or "our"). We reserve the right to modify these terms at any time; continued use of the app constitutes acceptance of any changes.

2. Eligibility & Age Requirements

• Minimum Age: You must be at least 13 years of age to use the Service.

• Guardianship: If you are between 13 and 18, you represent that you have reviewed these Terms with a parent or legal guardian who agrees to be bound by them.

• Account Responsibility: You are solely responsible for the security of your account. Any activity under your credentials is presumed to be yours.

3. Prohibited "Objectionable Content" (Zero-Tolerance)

To ensure a safe environment for a 13+ audience and to comply with App Store regulations, the following content is strictly prohibited. Gagged maintains a zero-tolerance policy and will remove content or ban users at its sole discretion:

• Sexual Content & Nudity: No pornography, sexually suggestive imagery, or "erotic" roleplay.

• Child Safety: Any content that exploits or endangers minors. This is a "one-strike" permanent ban.

• Self-Harm & Suicide: No content that encourages, instructs, or glorifies self-injury, eating disorders, or suicide.

• Doxxing: No sharing of anyone's private information (address, phone number, school, SSN) without their explicit consent.

• Slurs & Hate Speech: No use of racial, religious, or homophobic slurs, even if used "ironically" or in a song lyric.

• Bullying & Harassment: No targeted "call-out" posts, stalking, or repetitive unwanted messaging.

• Impersonation: Users cannot pretend to be celebrities, public figures, or other users to deceive people.

• Graphic Violence: No "shock" content, gore, or real-world physical violence/mutilation.

• Threats: No threats of physical harm, even if intended as a joke.

• Illegal Sales: No facilitating the sale of drugs, alcohol, tobacco, vaping products, weapons or any control items whatsoever.

• Promoting Extremism: No recruitment or promotion for terrorist or hate organizations on this platform.

• Spam & Scams: No "get rich quick" schemes, phishing links, or repetitive bot-like posting.

• Copyright Infringement: No posting movies, music, or art that the user does not own or have a license for.

• Malicious Software: No posting links to viruses, malware, or sites designed to compromise user data.

• Scraping & Hacking: No using automated bots to crawl the app or attempting to "break" the app’s code.

• Excessive Profanity: While some swearing is allowed in 13+ apps, "excessive" or "gratuitous" use of F-words or highly offensive language in titles or bios should be banned.

• Dangerous Challenges: No promotion of "viral challenges" that involve physical risk with high potential for harm or damage to another individual or propertyx (e.g., challenges involving fire, choking, or dangerous heights).

4. Safety Enforcement & Moderation

• The Right to Monitor: We reserve the right (but have no obligation) to monitor, review, and filter User-Generated Content (UGC).

• User Reporting: The Service provides tools for users to report objectionable content and block other users. We commit to reviewing reports within 48 hours.

• Sanctions: Violations may result in content removal, temporary suspension, or a permanent ban without prior notice or refund of any associated services.

5. Intellectual Property & Licenses

• Your Content: You retain ownership of your posts, but you grant Gagged a worldwide, royalty-free, perpetual, and transferable license to host, display, and distribute your content.

• Company Property: All app designs, logos, and code are the exclusive property of the Company. You may not reverse-engineer or "scrape" the app.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, GAGGED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL CONTENT POSTED BY THIRD PARTIES.

7. Limitation of Liability & Indemnity

• Liability Cap: To the maximum extent permitted by law, Gagged and its affiliates shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits) arising from your use of the app.

• Indemnification: You agree to defend and hold Gagged harmless from any legal claims, damages, or costs (including attorney fees) arising from your breach of these Terms or your violation of any law or third-party right.

8. Mandatory Arbitration & Class Action Waiver

• Binding Arbitration: You agree that any dispute with Gagged will be resolved through individual, binding arbitration in the State of Texas, rather than in court.

• No Class Actions: You waive your right to participate in a class-action lawsuit or class-wide arbitration.

9. Legal Compliance (COPPA & DMCA)

• Children’s Privacy: We do not knowingly collect data from children under 13. If we discover such data, we will delete it immediately.

• Copyright: If you believe your work has been infringed, please report the content with a formal DMCA Takedown Notice and Gagged will review the claim within 48 hours.

10. Termination of Service

We may terminate or suspend your access to Gagged immediately, without prior notice or liability, for any reason—including, without limitation, a breach of these Terms.
